1. Acceptance of Terms

By registering for or using the Bare Bone Outdoor Services platform (“Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not register or use the Platform. These Terms constitute a legally binding agreement between you and Bare Bone Outdoor Services LLC, a Texas limited liability company (“Company,” “we,” “us,” or “our”).

2. Platform Description

Bare Bone Outdoor Services operates an online marketplace connecting hunters, landowners, guides, and portfolio operators for dove and waterfowl hunting in Texas. The Platform facilitates listing discovery, booking, payment processing, and communications. The Company acts as a marketplace intermediary and is not a party to hunting agreements between landowners, guides, and hunters.

3. Eligibility

You must be at least 18 years of age to use this Platform. By registering, you represent that:

  • All information you provide is accurate, current, and complete.
  • You have the legal authority to enter into these Terms.
  • You hold all required federal and state licenses, permits, and certifications required for your role on the Platform.
  • For hunters: you hold a valid Texas Hunting License and current HIP (Harvest Information Program) certification. For waterfowl bookings, a valid Federal Duck Stamp is required.
  • For landowners and portfolio operators: you are the property owner, an authorized lease holder, or a duly authorized agent with legal authority to grant hunting access to the property.
  • For guides: you hold all required Texas state and, where applicable, federal commercial guiding permits.

4. Anti-Circumvention Policy

Important — Zero Tolerance

All transactions for hunts connected through the Platform must be completed through the Platform. You may not, directly or indirectly, arrange, accept, or complete payment for any hunting booking outside of the Platform’s payment system for any hunter-landowner or hunter-guide relationship initiated through the Platform.

  • First offense: Formal written warning and temporary suspension.
  • Second offense: Permanent account ban, forfeiture of all pending payouts, and potential legal action to recover Platform fees lost as a result of circumvention.

Landowner and hunter contact information is withheld until 48 hours before the confirmed hunt date to protect the integrity of the Platform. Sharing or soliciting off-platform contact details to arrange side payments is a violation of this policy.

5. Bookings and Payments

Instant Book: Payment is captured immediately upon booking confirmation. The landowner receives a payout 48 hours after the hunt date, subject to no open disputes.

Request-to-Book: A payment authorization is placed on your card at submission. The card is not charged until the landowner approves the request. If declined or the landowner does not respond within 24 hours, the authorization is released and you are not charged.

Platform Fees: Platform fees are disclosed at checkout and are non-refundable except as required by applicable law or as determined by the Company in dispute resolution.

Stripe: All payments are processed by Stripe. By using the Platform, you agree to Stripe’s Terms of Service. The Company does not store credit card numbers or bank account details — all financial data is held by Stripe.

6. Cancellations and Refunds

Cancellation and refund terms are set per listing by the landowner and disclosed at checkout. Disputes regarding cancellations are handled through the Platform dispute resolution process. The Company’s determination in dispute resolution is final for Platform-mediated refunds.

Refunds for Request-to-Book listings declined by the landowner are automatic and full. Refunds for cancellations are subject to the listing’s cancellation policy.

7. Hold Harmless and Release of Liability

All users acknowledge that hunting involves inherent risks including personal injury, death, and property damage. By using the Platform:

  • Hunters are required to sign a Hold Harmless Agreement per booking before hunt confirmation.
  • Landowners and portfolio operators are required to sign a Landowner Hold Harmless Agreement at registration, which must be completed before any listing goes live.
  • Guides are required to sign a Guide/Company Hold Harmless Agreement at registration.

These agreements are in addition to, and do not replace, these Terms. In no event shall the Company be liable for personal injury, death, property damage, or any other harm arising from hunting activities arranged through the Platform. The Company is a marketplace only.

8. Federal and State Wildlife Laws

All users are solely responsible for compliance with all applicable federal and state wildlife laws, including but not limited to:

  • Texas Parks and Wildlife Department (TPWD) regulations for dove and waterfowl seasons, zones, bag limits, and shooting hours.
  • U.S. Fish & Wildlife Service (USFWS) migratory bird regulations, including the Federal Duck Stamp and HIP requirements.
  • Non-toxic shot requirement: All waterfowl hunting must use federally approved non-toxic shot. Use of lead shot for waterfowl is illegal and is grounds for immediate account suspension.
  • Baiting prohibition (zero tolerance): Hunting migratory birds over a baited field is a federal crime. Any account found to have done so will be permanently banned and reported to USFWS.

9. Listings and Admin Approval

All property listings require admin approval before going live. The Company reserves the right to reject any listing that does not comply with Platform standards, applicable law, or these Terms, without obligation to provide a detailed explanation. Approved listings may be removed at any time if found to be in violation.

10. Reviews

Reviews may be submitted within 7 days of a payout being initiated for a completed booking. Reviews must be honest, first-hand accounts of the hunting experience. Reviews that are defamatory, fraudulent, or violate these Terms may be removed. The Company does not edit, curate, or guarantee the accuracy of user reviews.

11. Account Suspension and Termination

The Company may suspend or terminate your account for:

  • Violation of these Terms or the Anti-Circumvention Policy.
  • Providing false or misleading information at registration or in listings.
  • Accumulation of Platform strikes (see Strike Policy in your account dashboard).
  • Fraud, chargebacks, or abuse of the Platform’s payment system.
  • Any conduct that endangers other users or violates applicable law.

Suspended accounts forfeit pending payouts pending dispute resolution. Permanently banned accounts forfeit all pending payouts.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy. The Platform collects and processes personal data including name, email, phone, hunting license numbers, and payment information (processed by Stripe). Tax information for 1099-K reporting is handled exclusively by Stripe and is never stored by the Company. Contact information between hunters and landowners/guides is withheld until 48 hours before a confirmed hunt date.

13. Intellectual Property

All Platform content, trademarks, logos, and software are the property of Bare Bone Outdoor Services LLC. Users retain ownership of their listing photos and content but grant the Company a non-exclusive license to display that content on the Platform. You may not copy, scrape, or reproduce Platform content without written permission.

14. Disclaimer of Warranties

The Platform is provided “as is” without warranties of any kind, express or implied. The Company does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. The Company makes no representations regarding the accuracy of listing information, hunter qualifications, or guide credentials.

15. Limitation of Liability

To the maximum extent permitted by applicable law, the Company’s total liability to you for any claim arising from your use of the Platform shall not exceed the total Platform fees paid by you in the 12 months preceding the claim. The Company is not liable for indirect, incidental, special, or consequential damages of any kind.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Tom Green County, Texas. You waive any objection to venue in those courts. Before filing any legal action, you agree to contact the Company at [email protected] and attempt to resolve the dispute informally for a period of 30 days.

17. Changes to These Terms

The Company reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. For material changes, the Company will make reasonable efforts to notify registered users by email.
