Hunter Hold Harmless & Agri-Tourism Participant Waiver

This waiver is executed per booking at the time of payment. By completing checkout, each hunter in the group acknowledges and agrees to the terms below. A separate Dropbox Sign copy is generated for each booking and delivered to the hunter’s email address.

1. Parties

This Hunter Hold Harmless and Agri-Tourism Participant Waiver (“Waiver”) is entered into between Bare Bone Outdoor Services LLC, a Texas limited liability company (“Company”), the property owner or lease holder identified in the booking (“Landowner”), and the hunter completing the booking (“Hunter”). This Waiver is executed per booking and governs each specific hunt date, property, and party composition for which it is signed.

2. Description of Activity

Hunter is participating in a hunting activity on private land in Texas, arranged through the Bare Bone Outdoor Services platform. The activity involves the use of firearms or archery equipment in an outdoor setting and carries inherent risks that cannot be eliminated regardless of the precautions taken by the Landowner, the Company, or any guide present.

3. Texas Agri-Tourism Act — Chapter 75A Notice

Statutory Warning — Required Under Texas Law

WARNING: Under the Texas Agri-Tourism Activity Liability Act (Chapter 75A, Texas Civil Practice and Remedies Code), there is no liability for an injury to or the death of a participant in an agri-tourism activity conducted at this property if the injury or death results from the inherent risks of the agri-tourism activity. Inherent risks of agri-tourism activities include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. You are assuming the risk of participating in this agri-tourism activity.

Hunter acknowledges receipt and understanding of the above statutory warning.

4. Assumption of Risk

Hunter voluntarily assumes all risks associated with participation in this hunting activity, including but not limited to:

  • Accidental firearm discharge, ricochet, or misfires by Hunter or other members of Hunter’s group;
  • Physical injury resulting from terrain features, uneven ground, fences, vegetation, and other natural or agricultural hazards;
  • Adverse weather conditions, including extreme heat, lightning, flash floods, and other Texas weather events;
  • Encounters with wildlife, including venomous snakes, insects, feral hogs, and other animals;
  • Vehicle accidents or equipment malfunctions during transport to or from the hunting area;
  • Injury resulting from Hunter’s own negligence or failure to follow safety instructions provided by the Landowner or guide.

5. Release and Hold Harmless

In consideration of being permitted to access the property and participate in the booked hunt, Hunter — on behalf of Hunter and Hunter’s heirs, personal representatives, and assigns — agrees to:

  • Release, discharge, and hold harmless the Landowner and all Landowner’s agents from any and all claims, actions, damages, or liabilities arising from Hunter’s participation in the hunting activity, including claims arising from Landowner’s negligence except for gross negligence or willful misconduct;
  • Release, discharge, and hold harmless the Company and its members, managers, employees, and contractors from any and all claims arising from Hunter’s participation in the hunting activity. The Company is a marketplace and booking platform only — it does not control, supervise, or participate in hunts, does not own or manage the property, and is not present during any hunting activity;
  • Release, discharge, and hold harmless any guide assigned to the booking from claims arising from the guide’s good-faith execution of guiding duties, except for gross negligence or willful misconduct.

6. Indemnification

Hunter agrees to indemnify, defend, and hold harmless the Company, the Landowner, and any guide from and against any claims, damages, costs, and expenses (including reasonable attorney’s fees) arising from: (a) Hunter’s violation of any federal or state wildlife regulation during the booked hunt; (b) Hunter’s violation of the property rules set forth in the listing; (c) damage to the property caused by Hunter or a member of Hunter’s group; (d) Hunter’s conduct constituting gross negligence or willful misconduct.

7. Regulatory Compliance

Hunter represents and warrants that at the time of each booked hunt:

  • Hunter holds a valid Texas Hunting License for the species being hunted;
  • Hunter has completed HIP (Harvest Information Program) certification for the current season;
  • For waterfowl hunts: Hunter possesses a valid Federal Duck Stamp;
  • Hunter is not under any suspension, revocation, or other restriction that would prohibit Hunter from lawfully hunting the target species;
  • Hunter will comply with all applicable bag limits, shooting hours, and equipment restrictions set by the Texas Parks and Wildlife Department and U.S. Fish & Wildlife Service.

Hunter acknowledges that any wildlife violation occurring during the booked hunt is Hunter’s sole legal and financial responsibility. The Company accepts no liability for regulatory violations by hunters.

8. Waterfowl — Non-Toxic Shot Requirement

For any waterfowl booking (duck, geese, teal), Hunter acknowledges that federal law prohibits the use of lead shot for waterfowl hunting. Hunter agrees to use only non-toxic shot (steel, bismuth, tungsten, or other USFWS-approved non-toxic alternatives) for all waterfowl hunts booked through the Platform. Violation of this requirement is solely Hunter’s responsibility and may result in federal prosecution in addition to Platform account termination.

9. Property Rules

Hunter agrees to abide by all property rules, shooting hours, and access restrictions set forth in the listing and communicated by the Landowner or guide. Failure to comply with property rules may result in removal from the property, forfeiture of the booking fee, and suspension from the Platform.

10. Anti-Circumvention

Hunter agrees that all bookings for hunting access initiated through the Platform must be completed through the Platform’s payment system. Hunter shall not arrange or pay for repeat or future hunting access directly with any Landowner or Guide contacted through the Platform outside of the Platform’s booking system. Violation of this provision may result in account termination and the Company reserves the right to seek damages for lost platform fees.

11. Emergency Medical Authorization

In the event Hunter is incapacitated and unable to provide consent, Hunter authorizes the Landowner, any guide, and any Company representative present to seek emergency medical treatment on Hunter’s behalf. Hunter agrees to be responsible for all medical costs incurred in connection with Hunter’s participation in the booked hunt.

12. Governing Law

This Waiver is governed by the laws of the State of Texas. Any disputes arising hereunder shall be resolved in the state or federal courts of Tom Green County, Texas.

13. Acknowledgment

Hunter acknowledges that this Waiver has been read carefully, that Hunter understands its contents and legal effect, and that Hunter has had sufficient opportunity to seek independent legal advice before executing it. Hunter executes this Waiver voluntarily and without duress as a condition of accessing the booked property and participating in the hunting activity.
