This Addendum supplements and is incorporated into the Hunter Hold Harmless & Agri-Tourism Participant Waiver. It applies to all bookings for duck, teal, specklebelly goose, snow goose, Ross’s goose, and Canada goose hunts. Both documents are executed together at the time of waterfowl booking checkout.
1. Scope
This Waterfowl Hunt Waiver — Species-Specific Addendum (“Addendum”) applies to all waterfowl bookings made through the Bare Bone Outdoor Services platform, including but not limited to teal season, regular duck season, regular goose season, specklebelly goose season, and the Light Goose Conservation Order (LGCO) special season. For LGCO-specific terms, see the LGCO Special Season Waiver.
2. Federal License and Permit Requirements
Hunter confirms that at the time of each waterfowl hunt booked through the Platform:
- Hunter possesses a valid Federal Migratory Bird Hunting and Conservation Stamp (“Federal Duck Stamp”) for the current license year, signed in ink across the face of the stamp;
- Hunter has completed HIP (Harvest Information Program) certification for the current license year and state of residence;
- Hunter holds a valid Texas Hunting License;
- For teal-only season: Hunter is aware that a separate teal season license or endorsement may be required and has obtained all applicable authorizations.
3. Non-Toxic Shot — Absolute Requirement
Federal Law — Zero Exceptions
The use of lead shot for hunting migratory waterfowl is prohibited under federal law (50 C.F.R. § 20.21(j)). Violation is a federal offense punishable by fines up to $15,000 and/or imprisonment.
Hunter acknowledges and agrees that:
- All ammunition used during any waterfowl hunt booked through the Platform must consist exclusively of non-toxic shot types approved by the U.S. Fish & Wildlife Service (including steel, bismuth, tungsten-iron, tungsten-polymer, tungsten-matrix, and other approved alternatives);
- Lead shot, lead-core shot, or any unapproved shot material is strictly prohibited;
- Hunter is solely responsible for verifying that all ammunition brought to the hunt complies with this requirement;
- The Company, Landowner, and any guide are not responsible for Hunter’s failure to use compliant ammunition and accept no liability for federal violations resulting from Hunter’s noncompliance;
- Hunting with prohibited shot on a Landowner’s property may expose the Landowner to federal scrutiny, and Hunter agrees to indemnify the Landowner and Company against any claims arising from Hunter’s use of prohibited shot.
4. Federal Baiting Prohibition — Zero Tolerance
Zero Tolerance Policy
Hunting migratory birds over or near a baited area is a federal crime under the Migratory Bird Treaty Act (16 U.S.C. § 703 et seq.), regardless of whether the hunter had knowledge of the bait.
Hunter acknowledges and agrees that:
- Hunter will not hunt waterfowl over, around, or in the vicinity of any baited area as defined under federal regulations (50 C.F.R. § 20.11(k)), including areas where grain, salt, minerals, or other attractants have been deposited to lure migratory birds;
- If Hunter discovers evidence of baiting on the booked property, Hunter will immediately cease hunting activity and notify the Landowner and the Company;
- Hunter will not bring bait or attractants onto any property booked through the Platform for use in connection with waterfowl hunting;
- Violation of the baiting prohibition is grounds for immediate termination of the booking without refund, permanent account ban, and referral to U.S. Fish & Wildlife Service law enforcement.
5. Bag Limits and Season Dates
Hunter is solely responsible for knowing and complying with all applicable bag limits, possession limits, and season dates set by the U.S. Fish & Wildlife Service and the Texas Parks and Wildlife Department for each species hunted. Hunter acknowledges that:
- Bag limits, season dates, and zone boundaries for waterfowl change annually and must be verified each license year through the current Texas Migratory Game Bird Proclamation and the Federal Migratory Bird Hunting Regulations;
- The Platform does not guarantee that listed hunt dates fall within open seasons — Hunter is responsible for verifying season compliance before booking;
- Over-limit takes are Hunter’s sole legal responsibility and do not create any liability for the Landowner or the Company.
6. Decoy Equipment and Electronic Calls
During regular waterfowl seasons (duck, teal, and regular goose), electronic calls are prohibited under federal law. Hunter agrees not to use electronic bird calls during regular season waterfowl hunts. Decoy placement and retrieval are Hunter’s responsibility. The use of live decoys is prohibited under federal law. See the LGCO Addendum for rules applicable to Light Goose Conservation Order hunts, during which electronic calls and unplugged shotguns are permitted.
7. Retrieval Dogs
Hunter may bring a trained retriever to the booked hunt subject to Landowner’s approval as noted in the listing. Hunter is responsible for controlling the dog, preventing property damage, and complying with any livestock or agricultural restrictions applicable to the property. Hunter accepts full responsibility for any damage caused by Hunter’s dog.
8. Additional Assumptions of Risk — Waterfowl Specific
In addition to the general risks identified in the Hunter Hold Harmless & Agri-Tourism Participant Waiver, Hunter specifically assumes the following risks inherent to waterfowl hunting:
- Risks associated with hunting in or near water, including slipping, falling into water bodies, hypothermia in cold weather, and drowning;
- Risks associated with hunting in flooded fields, marshes, or standing water, including hidden obstacles, unstable footing, and submerged hazards;
- Risks associated with pre-dawn setup and hunting in low-light conditions;
- Risks from dense cover obscuring hazards, including fence lines, ditches, and drop-offs;
- Risks from cold and wet weather conditions typical of Texas waterfowl seasons.
9. Incorporation
This Addendum is incorporated by reference into the Hunter Hold Harmless & Agri-Tourism Participant Waiver and the Platform Terms of Service. All terms, representations, releases, and indemnifications in those documents apply with equal force to waterfowl bookings, together with the additional terms stated herein.
